Marina Del Rey Condominium $15 Lawsuits, Toronto


The Toronto Waterfront area can be a beautiful place to live. I thought all my dreams had come true when I moved in to my condominium 23 years ago. It has the most spectacular view of this city! However, I soon discovered that purchasing this property would become my biggest nightmare! I have now been homeless for 13 years!

This is a cautionary tale about what happens to a condo owner at Marina Del Rey Phase I, 2261 Lake Shore Blvd. W, who is forced to commence legal action in an effort to rebuild her home after years of continuous water flooding problems, mismanagement, neglect of duties, and bad faith displayed by insurance companies.

I have started this blog with the hope that I can provide help and encouragement to others who find themselves in a similar situation. Insurance companies and corporations have lots of money and lawyers to fight us. However, we have the power of the internet and the social media to connect, support each other, and exchange helpful information.

Slipped in my Leaking Condo and Broke my Arm! I can't work as a Landscaper!

My enthusiasm has been short lived.  I submitted dozens of written requests to fix the leaking window problem to Management and the Board of Directors in April and May 2011. 

There has been no progress or repairs.  After nearly a solid month of rain, my window area is more wet than ever!

On Thursday May 19 2011, I called the City of Toronto to have a By-Law officer inspect my unit because the leaking windows violate  section 629-21 of the Toronto Municipal Code of Property Standards for mult-residential dwellings.  There are also large holes in the walls and ceilings cut open by plumbers hired by Management in September 2009.  This is a violation of section 629-27.  I am getting second hand smoke and insects coming into my unit from the open holes.  The living conditions in this unit are against the law and dangerous.

On Sunday May 22, 2011 I slipped on the wet floor caused by the defective leaking windows and broke my left wrist, and injured my right collar bone, shoulder and elbow.  I am very upset because I have to take at least 8 weeks off from work so that my body can heal.  I am a self employed ladscaper specializing in fish pond maintenance.  I have a cast on my arm from my fingers to my elbow.  I can't carry things or put my hand underwater.

My body is aching from the fall - I am so upset!  What is going to happen to my business if I can't work?
